Have a Happy and Safe Halloween

With Halloween marking the beginning of the holiday season we at Cohen Battisti wanted to remind you to plan ahead and not to drive under the influence. According to NHTSA (National Highway Traffic Safety Administration), nearly 60 percent of all Halloween highway fatalities across the country involved a driver with a BAC of .08 or higher. Florida’s DMV records show there were 33,625 DUI convictions in Florida in 2011 with a definite spike on the holidays such as Halloween.

In central Florida alone over the past week there have been a number of damaging car accidents due to people driving under the influence. DUI’s are a completely preventable crime and we hope this holiday everyone will decide before they drive a responsible way home. The staff at Cohen Battisti wants to wish everyone a Safe and Happy Halloween. Here are a few safety tips from MADD (Mother’s Against Drunk Driving) to remember:

1: Designate a sober driver before heading out for Halloween Festivities

2: Ensure you have the telephone number of a local cab company should the need arise

3: If you are trick or treating take a flashlight and check the batteries prior to leaving

4: Remain extra alert especially when crossing the street.

5: Never serve alcohol to anyone under the age of 21

From all of us at Cohen Battisti we wish everyone a Happy and Safe Halloween

Are You Prepared for a Hurricane?

Even as we are nearing November, Florida is once again reminded that hurricane season is still upon us. The escalation of Hurricane Sandy to a Category Two storm is a grim reminder of how quickly these storms can intensify. If you have lived in Florida through one of these storms you have undoubtedly witnessed the damage they can cause. A crucial part of hurricane preparedness is protecting your home and your business.

Homeowners should make sure their insurance polices are up to date and review coverage for the various damages that their homes can incur. Business owners need to be sure their equipment and facilities they need to operate are protected. Contractors want to have Assignment of Benefits (AOB) forms ready to be signed before beginning any jobs. While most claims go smoothly, insurance disputes still arise and have to be legally addressed. Our firm provides professional Insurance Dispute legal representation and has represented thousands of individuals, contractors and business owners in their insurance claims.

When extreme weather conditions arise throughout Florida, so do “Bad Faith Tactics” of insurance carriers. When insurance companies refuse to pay legitimate claims, try to settle for less than a claim is actually worth or deny a claim altogether call an experienced Insurance Dispute Attorney at Cohen Battisti for a free confidential case review.

How Can I Lower my Child Support Payment?

How can I lower my child support payment?

With the current state of the economy, job loss and unemployment on the rise, the question of child support modification is being asked more frequently. Child support is based on the needs of the child or children, including child care and medical care costs, and the income of each parent. Our firm provides professional Family Law representation for all aspects of family law including child support modification.

If the income of a parent changes after the original agreement is made, the need for modification may arise. Our firm understands the challenges of unemployment and under-employment. If there are changes in the child’s medical care or day care modification may also be needed. Perhaps the child’s living arrangements have changed and they are now spending more time at the contributing parent’s residence. This too could be a contributing factor to have the child support arrangement modified.

A substantial change sufficient to warrant a modification of your support can often be difficult to prove. Many times the client will only have one shot at presenting the case properly to the court which means that the client should be very selective as to which law firm they retain to represent them. At Cohen Battisti we know all of this can be confusing and frustrating at times. Our experienced Family Law attorneys will guide you through the process. We offer free confidential case reviews for your convenience.

Have your Civil Rights Been Violated?

Have you have ever been a victim of harassment? Have you ever tried to report discrimination only to face retaliation? People have fought throughout history to ensure our basic civil liberties were established and protected. Federal statutes prohibit discrimination on the basis of race, color, sex, disability, religion, familial status and national origin. Everyone is entitled to certain rights under the law and if this is happening to you Cohen Battisti can help.

Recently the Justice Department announced that it has entered into a settlement agreement with the Northeastern Local School District in Springfield, OH resolving allegations of racial discrimination of students in their district. These students faced significant harassment because of their race and then endured even more in retaliation for reporting it. No person should have to experience something like this. Unfortunately cases such as this happen in our community and too often go unreported, or worse are ignored.

The Civil Rights Division of the Department of Justice was established to protect the rights for everyone.  At Cohen Battisti we believe in justice and will fight for your rights. We offer free confidential consultations at your convenience. Every client has his or her own unique issues and concerns and Cohen Battisti is here to assist you through this difficult time in your life.
