Americans with Disabilities Act – Public Accommodations

The Americans with Disabilities Act (ADA) was created to ensure the rights of all persons with disabilities.  A person with a disability is defined as an individual with a physical or mental impairment. The law protects not only persons with a disability but also anyone who has a history of a disability. The act covers five main categories and at Cohen Battisti  we understand the complexity of these statutes and have experience litigating ADA law.

One of the major titles covered in the Americans with Disabilities Act is Public Accommodations which encompasses the Architectural Barriers Act (ABA). Did you know that this requires that buildings constructed with Federal funds adhere to the Federal standards for accessibility? Or that new construction must comply with ADA Accessibility Guidelines (ADAAG)? Additionally all public buildings must also provide reasonable accessibility regarding physical barriers as well as other service aids. Although the law offers protection to anyone with a disability, enforcement of this law is complaint-driven and the law is enforced in a variety of ways depending on the complaint.
